If your business uses a name that is not its legal name, you need a Certificate of Assumed Name. This certificate is also called a "doing business as" (DBA) certificate. You must file this certificate with the New York State Department of State (NYSDOS).

Without this certificate, your business must use its legal name everywhere. The legal name is the name on your incorporation documents.

You can file the Certificate of Assumed Name at the same time as your incorporation documents.

If you want to understand more about this, you should consult with an attorney.

General partnerships and sole proprietorships do not file this certificate. They should file a business certificate with the county clerk in their county or borough. Learn more about business certificates for sole proprietorships and general partnerships.
